Delta council banned the distributuion, rental, and sale of pornographic videos last night. The by-law passed would prevent any new business to rent and or sell adult videos. The by-law also includes a sub-section to ban the production (In Delta) of adult content for film distribution. Existing businesses would be given a reprive and 'lawful conforming' clause to allow them to continue their business until they decided to close.

Dirty movies and other naughty products are the target of a proposed new bylaw that would forbid their sale and rental in Delta.
The regulation would eliminate a loophole that appears to permit both “adult entertainment” and “adult video” stores everywhere but the new Delsom Estates housing mega-project in North Delta.
A staff report said the loophole was created when the municipality imposed a ban on such stores specifically in Delsom without extending it to the rest of the community.
As approved by council Monday night, the new rules would “prohibit the use of any lands for the purpose of sale or rental of adult entertainment products.”
Existing stores would be allowed to stay in business as “legally non-conforming.”
The bylaw cannot take effect until after a public hearing has been held.
Coun. Robert Campbell was the only member of council to vote against the anti-pornography regulation.
Campbell, a lawyer, warned the ban leaves the municipality open to a Charter of Rights lawsuit.
He added when people can dial up hard-core porn on the internet or watch it through their local cable provider, going after local stores makes little sense.
“We’re tilting at windmills here and I think we have better things to do,” Campbell said.
Coun, Vicki Huntington convinced the rest of council to include the production of adult videos in the ban.
“If we’re going to be prudes, we might as well cover the bases,” said Huntington.
After the meeting, Huntington said she favours the new rules because she doesn’t want to see a sudden increase in the number of adult outlets in Delta.
The regulations were drafted shortly after a Surrey adults-only video store leased premises in North Delta.
It hasn’t opened yet.
A staff report said there are five other video rental stores that sell or rent X-rated fare in Delta, four in North Delta and one in South Delta, and three adult entertainment stores that sell “adult toys,” magazines, lingerie and other products, one in the south and two in the north.
